1. 1. This matter is taken up through Hybrid Mode.
2. Heard learned counsel for the parties.
3. The present Writ Petition has been filed with the following
prayer:
“to declare that the impugned circular under
Annexure-3 is not an impediment for the
appointment of the applicant to any Goup ‘C’
post
and/or
alternatively
hold
that
the
impugned
circular
under
Annexure-3
is
ultravires Article-14 of the Constitution of India
as well as Odisha Civil Services (Rehabilittion
Assistance) Rule, 1990 and consequently direct
the respondent to appoint the applicant in any
Group-C post from the intial date on regular
basis with regular scale of pay and allowances
as due as admissible and further declare that
the Group ‘C” and Group ‘D’ contractual
appointment, 2013 is not applicable to the case
of the applicant.”

Considering the nature of prayer made in the Writ
Petition,
the
Petitioner
is
permitted
to
make
a
fresh
representation before Opp. party No.1 within a period of three
weeks days from today.

It is observed that if such a representation is filed by the
Petitioner ventilating his grievances, the same shall be
considered by Opp. party No.1 in accordance with law within a
period of three months from the date of receipt of such
representation. The order so passed by Opp. Party No.1 be
communicated to the Petitioner also.

With the aforesaid observation and direction, the Writ
Petition is disposed of.
