The

two

Petitioners

are

stated

to

be

borrowers/guarantors for credit facility availed in the

year 2005/2006, which were declared as NPA in the

month of February, 2008. The notice under Section

13(2) of the SARFAESI Act, 2002 issued on 25.02.2008,

thereafter, more than three occasions, the settlement

arrived under OTS schemes, had failed because of non-

adherence of the terms and conditions by the

Petitioners/borrowers.

3. Be that as it may, the present writ has been filed,

assailing the sale notice dated 22.07.2021, the

consequent sale certificate and sale deed executed in

favour of Shri SK Hapijullah-Opposite
