1. It appears that the Balasore Municipal Council (BMC) has

already issued notice dated 12^th February, 2021 to 13 persons

who were alleged to be encroaching on the public road and drain

(Annexure-5). In the circumstances, the only direction that

requires to be issued is that if not already disposed of, the hearing

on the said notice shall take place and a reasoned order shall be

passed thereon in respect of each of the alleged encroachers not

later than 9^th May, 2022. It will be open to the Petitioner also to

be heard by the BMC in such process. Mr. Panda learned counsel

appearing for the BMC undertakes to communicate this order to

the BMC forthwith for
