This is an application under Section 11 (6) of the Arbitration

and Conciliation Act, 1996 for the appointment of an arbitrator.

Admittedly, there exists an arbitration clause in the contract

entered into between the parties. It is not being disputed by learned counsel

for the parties that under the said clause an independent Arbitrator is to be

appointed to settle the disputes and differences between the parties
