Heard.

The landlord/respondent after seeking permission to amend the

rejoinder filed a fresh affidavit in his examination-in-chief, wherein he

incorporated the amended plea.

Learned counsel for the petitioner had initially argued that the

landlord/respondent was not competent to file fresh affidavit. However, he

has confined his submission to the extent that the subsequent affidavit filed

by the respondent be considered as supplementary affidavit only with regard

to the amendement allowed by the Court. The plea putforth by learned

counsel for the petitioner has not been contested by learned counsel for the

respondent.

In view of the above, this revision petition is disposed of with

observations that second affidavit filed
