The petitioner has invoked the jurisdiction of this Court

under Article 227 of the Constitution of India for a direction to the

learned Civil Judge (Jr. Divn.), Dera Bassi to decide his application

expeditiously, filed under Order 39 Rules 1 & 2 of the Code of Civil

Procedure, 1908 (for short ‘CPC’).

Learned counsel for the petitioner has submitted that the

petitioner has filed the suit for permanent injunction for restraining the

defendants from interfering in his peaceful usage of the passage shown

as ABCD in the site plan, comprising in Khasra No.1632 and 1633 for

reaching to the metalled road (Phirni) and further to restrain defendants

from encroaching upon the
