The petitioner has invoked the revisional jurisdiction of this Court

to challenge the order dated 31.01.2009, passed by the learned Motor

Accident Claims Tribunal, Panipat acting as Executing Court.

The learned Motor Accident Claims Tribunal on an application

moved by the claimant had awarded compensation on account of motor-

vehicular accident. The total amount awarded was Rs.1,59,673/- (Rs. One

Lac Fifty Nine Thousand Six Hundred Seventy three only). The Insurance

Company was directed to pay the amount with liberty to recover it from the

owner of the vehicle, as the terms of the insurance were violated.

The petitioner challenged the order of the learned Executing

Court in ordering the recovery from the petitioner.
