This appeal has been filed by the plaintiff assailing the

correctness of order dated 11.10.2021, passed by the Additional District

Judge while dismissing an application under Order 39 Rule 1 & 2 CPC to

restrain the respondent from using deceptively similar trade name, trade

mark or device.

For the purpose of the decision of the present case, it is

appropriate to notice that the plaintiff launched a platform on 14.01.2017 on

facebook as well as on various other networking applications. Many

renowned brands and artists have collaborated with the plaintiff to market

their home décor products under the name and style of “DECOR ALLEY”.

The plaintiff claims that she created the instagram and twitter handles which

are quite popular
