The petitioner has filed this writ petition being aggrieved by the
fact that the respondent-authorities are treating him as a general category
candidate while considering his claim for admission in the MBBS course for
the session 2021-2022, whereas he has in fact applied as a BCA candidate.
Learned counsel for the petitioner submits that the respondent-
authorities have wrongly rejected his claim as the BCA candidate by stating
that at the time of filling up his admission form (Annexure P-1), he had
mentioned that he is a creamy layer candidate, whereas there is no such
requirement therein. Nor is there any requirement in the said form to specify as
to whether an applicant is a creamy layer or a non-creamy layer candidate. He
further submits that the petitioner has raised a grievance in this regard before
the respondent-authorities, but the issue has not been examined.
Mr. Deepak Balyan, learned Additional Advocate General,
Haryana submits that as the process of counselling is going on, the Director,
Medical Education and Research (DMER), Haryana or the competent authority,
whether it be the Counselling Committee or some other authority designated by
the State of Haryana, would immediately look into the matter and take a
decision in respect of the petitioner9s grievance by today or tomorrow.
In view of the aforesaid submission made by learned counsel for
the petitioner as well as the statement of learned State counsel, the writ petition
stands disposed of.
