conferencing on account of outbreak of pandemic COVID-19.

Notice of motion.

Mr. Shireesh Gupta, Sr. DAG, Punjab puts in appearance

on behalf of respondents no. 1,5 and 6.

Mr. Vikas Chatrath, Advocate puts in appearance on his

own on behalf of respondents no. 2 to 4.

The petitioner who has retired from the Education

Department on 31.12.2000 as Centre Head Teacher of Govt.

Elementary School, Bajwara, District Hoshiarpur, is aggrieved over

the orders of the respondents issued vide letter bearing No. 6575

dated 15.4.2021 for recovery of Rs 1,65,363/- being over payment

so made to him. As has been fairly conceded by the counsel for the

respondents that inspite of due representation by way of Annexure

P/2 made by the petitioner, the respondents had gone ahead with

making deduction of the amount in instalments.

Be so as it may. It would suffice the ends of justice if

directions are issued to the respondents to first consider and

dispose of the representation of the petitioner Annexure P/2 within

one month of the receipt of the copy of this order and may if deemed

it appropriate call the petitioner for personal hearing as well. Till

then no recovery on the basis of alleged claim shall be made by the

respondents and if any deduction has been made on the basis of the

the said letter, the same shall be refunded for the time being to the

petitioner. The petition as such stands disposed off.
