On an application filed by the private respondents for change in

turn of water, the relief was granted by the Deputy Collector. Against this

order, statutory appeal has been filed in which ex parte stay was granted

vide order dated 21.04.2022. The same has been vacated vide order dated

22.04.2022 only on the ground that the office brought to the notice of the

concerned officer that a caveat had been filed in the case. It is submitted

that the ex parte interim stay was granted till the first hearing of the case and

thus, vacation of the same without notice to the petitioners was illegal.
