Respondents
CORAM:- HON'BLE MR. JUSTICE T.S.THAKUR, CHIEF
JUSTICE
HON'BLE MR. JUSTICE JASBIR SINGH
Present: Mr.Vivek Sharma, Advocate for the petitioner
Mr. Amol Rattan Singh, Addl. A.G. Punjab for the respondents
…..
T.S.Thakur, C.J. (Oral)
The only grievance made in this writ petition filed in public
interest is that Auto-Rickshaw drivers plying in Jalandhar are violating
permit conditions, in terms whereof they cannot take a passenger outside the
municipal limits, for which the permit has been granted. The grievance has
been made by particular reference to the Rikshaws plying within the
Municipal Corporation limits of Jalandhar. The allegation is that the
Rickshaw owners and the drivers are being allowed by the authorities to ply
beyond the municipal limits also.
Mr. Amol Rattan Singh, Addl. A.G. Punjab submits on
instructions that effective steps are being taken by the authorities to prevent
Auto Rickshaws plying beyond the municipal limits concerned, for which
the permits have been granted. He submits that not only the District
Transport Officer but even the traffic police authorities have instructions to
Civil Writ Petition No.2911 of 2007
proceed against any Auto Rickshaw plying in violation of the terms and
conditions of the permit.
In the circumstances, therefore and keeping in view the
submissions made by Mr.Singh all that we need say is that the authorities
shall continue their efforts to prevent violation of the terms and conditions
subject to which the permit holders are allowed to ply their Auto Rickshaws
within the Municipal Corporation limits. The Inspector General of Traffic
Police shall in this regard issue a specific direction to the traffic authorities
within his jurisdiction and so shall the State Transport Commissioner to
ensure that there is no violation of the permits subject to which three
wheeler/ Auto Rickshaws are allowed to operate in municipal limits.
With these observations and directions the writ petition is
disposed off leaving the parties to bear their own costs.
