This order disposes of above named two
revisions arising out of a common judgment dated March 19th, 2012
passed by Additional Sessions Judge, Fathabad whereby
petitioners were imposed penalty of Rs.1 lac each in proceedings
under Section 446 of the Code of Criminal Procedure.
Pirthi-petitioner is undergoing imprisonment for
life and is lodged in Central Jail, Hisar. He was released on parole
on April 12th, 2010 for six weeks. He was to surrender before the
Jail authorities on May 24th, 2010. He did not surrender because his
mother fell sick. He moved application (Annexure P-5) before the
Superintendent of Jail but the same was declined.
The petitioner surrendered on June 14th, 2010.

Subhash Chander and Mahender Singh
(petitioners) stood surety for Prithi and furnished surety bonds
before the authorities.
Learned counsel for the petitioners has
contended that the convict has surrendered before the Jail
Authorities of his own. Earlier he could not surrender on account of
unavoidable circumstances as stated aforesaid. It has been further
urged that it is very difficult for the petitioners to eke out their
livlihood.
The submissions advanced by learned counsel
for the petitioners being convincing, the petitions are accepted and
the amount of surety bonds is reduced from Rs.1 lac to Rs.5,000/-
each. The petitioners shall deposit the amount of fine on or before
August 10th, 2012.
