The petitioner seeks to assail the tender policy which was

published on 28.3.2013 and the bids were opened on 10.4.2013. Having

slept over the matter for 3 months in case of a tender m atter, we see no

reason to permit the petitioner to assail the tender process in question

now.

Learned counsel for the petitioner, however, submits that

same issue m ay arise in future tender policies. If that be so, we would

have to examine the policy at that stage. However, the grievance being

a limited one i.e. EPF Code is required to be submitted while the

petitioner being a Society employing less than 50 persons is not required

to have an EPF Code in law, is the matte
