This is an appeal against judgment dated 31.10.2003 passed by
Additional District Judge, Patiala.
There is delay of about three years in filing the appeal. Suit
was under Section 92 CPC. Vide impugned judgment, a scheme had been
made by the Court for providing management and utilisation of the funds of
Thakur Dawara.
On behalf of the appellant, it is stated that Arjan Dass, father of
the present appellant had died during the pendency of the suit and then
appellant had instructed the counsel to inform about the outcome of the suit
but counsel of the trial Court did not inform and therefore there had been
delay. It is pointed out that that suit was of the year 1991.
I have gone through the judgment. Suit related to the property
owned by Thakur Dawara. Suit was under Section 92 CPC for appointment
of regular manager of Religious institutions Thakur Dawara Dehdna Tehsil
Samana, District Patiala.
After the death of Arjan Dass, Sukhdev Dass had become LR
and had contested the suit. Vide detailed judgment, Additional District
Judge, Patiala had appointed a committee for management of the properties
and had even appointed chartered Accountant for the purpose of managing

the accounts etc.
When this appeal has been filed after a delay of about three
years, I do not find any good ground to condone the delay or even issue
notice.
As such, appeal is dismissed.
