HIGH COURT OF PUNJAB AND HARYANA
JABAR SINGH @ JABRA SINGH AND ANOTHER – Appellant
Versus
STATE OF HARYANA AND OTHERS – Respondent
/8415/2021

The court cannot issue a writ of mandamus to protect a person's life and liberty if the police have found that no cognizable offence has been committed.

Headnote:

CRIMINAL PROCEDURE CODE - PROTECTION OF LIFE AND LIBERTY - MANDAMUS - WRIT

Fact of the Case:

The petitioners filed a petition under Article 226 of the Constitution of India, seeking a writ of mandamus directing the respondents to protect their life and liberty from the private respondents. The petitioners alleged that the private respondents had filed a complaint before the Economic Offences Wing, which had summoned the petitioners.

Finding of the Court:

The court found that the police had investigated the complaint and found that it was a matter of personal dealings between the complainant and the petitioners, and that a civil suit was already pending between them. The court also found that the allegations levelled against the petitioners were not established and that no cognizable offence had taken place.

Issues: Whether the petitioners were entitled to a writ of mandamus directing the respondents to protect their life and liberty from the private respondents.

Ratio Decidendi: The court held that the petitioners were not entitled to a writ of mandamus because the police had found that no cognizable offence had been committed and that the matter was a civil dispute.

Final Decision: The court dismissed the petition.
