The challenge in this petition to the provisions of The Punjab

Prevention of Hum an Smuggling Act, 2012 and the rules framed

thereunder emanates initially from the grievances of the Punjab Travel

Agents

as

are

reflected

in

Memorandum,

Annexure

P/ 7

where

reconsideration was sought of Rules (2) (1) (a & b) and the licence fee

payable. It appears that the petitioner-Associations thereafter sought to

widen the scope of their objections by m aking another representation at

pages 116-125 dated 19.10.2013.

Learned counsel for the petitioners submits that having

revisited the whole issue, they would like to make a comprehensive

representation as to the rules which are required to be amended so as to

make them workable with the intent of the Act as, according to him,

there are certain unworkable rules. He submits that one or two sections

may also need some small am endments.

Representation, he says, will be m ade within a week.

In case such a representation is made, the respondents will

bestow consideration on the sam e and take a call within six weeks of

such representation being made and comm unicate the decision to the

petitioners. It is open to the respondents to call the representatives of

the petitioners which are associations of travel agents to see if the whole

issue can be resolved amicably.

The petition accordingly stands disposed of.

Copy of the petition be supplied to Mr. Harsimran S. Sethi,

Additional Advocate General, Punjab during the course of the day and

copy of the order be given dasti to both the learned counsels for the

parties under the signatures of the Bench Secretary.
