The appeal is being filed against order dated 19.10.2023 passed by Learned

Single Judge in CWP-23826-2023, vide which no interim stay was granted to the

appellant against his termination.

The question for consideration in the present appeal is that the appellant

who was working in the Baba Hira Singh Bhattal Institute of Engineering and

Technology which has now been closed, was sent on deputation from this institute to

Punjab Aids Control Society and he has been working since 2006. The grievance of

the appellant is that after constituting a committee for adjustment of the faculties of

this institute, he has not been adjusted in other institute like Maharaja Ranjit Singh

Punjab Technical University, Bathinda and IK Gujral, Punjab Technical Univeresity,

Jalandhar and the contractual employees have been adjusted. If appellant’s deputation

comes to an end, he will become jobless.

Learned State counsel, on instructions from Mr. Jagdeep Singh Sidhu,

Deputy Director, Department of Technical Education, has informed that in the

government department no adjustment has been made. However, the plea of the

appellant to adjust him in these two universities and also in the Punjab Aids Control

Society can be considered in due course.

Since this aspect has to be considered by the learned Single Bench, this

LPA is being disposed of and this issue will be taken up before the learned Single

Bench for final decision whether the State can intervene and get the appellant adjusted

permanently where he is working on deputation or similar universities.
