The present bail applications have been filed under Section
439 Cr.P.C. on behalf of the petitioners, who are in judicial custody
in connection with F.I.R. No.190/2020, Police Station Savina,
District Udaipur, registered for the offence under Sections 420,
406 & 120-B IPC.

Heard learned counsel for the petitioners and learned Public
Prosecutor. Perused the material available on record.
Learned counsel for the petitioners stated that offences are
triable by the Magistrate; that no investigation and recovery is
pending against the accused-petitioners; that charge-sheet has
been filed in the matter and further trial will take sufficiently long
time, therefore, benefit of bail may be granted to the accused
petitioners.
On the contrary, learned Public Prosecutor opposed the bail
applications of the accused-petitioners and stated that earlier four
cases of likewise nature are registered against the accused-Sanjay
Satpati and six cases are registered against the accused-Girish
Gandhi @ Gagan Gandhi but does not controvert the remaining
arguments.
Having regard to the facts and circumstances of the case,
particularly to the fact that offences are triable by Magistrate and
trial will take sufficiently long time, therefore, without expressing
any opinion on the merits/demerits of the case, this Court is of the
opinion that the bail applications filed by the petitioners deserve to
be accepted.
Consequently, both the bail applications are allowed. It is
ordered that the accused-petitioners – (1) Sanjay Satpati S/o Sh.
Gati Krishan Satpati @ D.k. Satpati, and (2) Girish Gandhi @
Gagan Gandhi S/o Vishambar Gandhi, arrested in connection with
F.I.R. No.190/2020, Police Station Savina, District Udaipur, shall

be released on bail, if not wanted in any other case, provided each
of them furnishes a personal bond of Rs.50,000/- (Rupees Fifty
Thousand) and two sureties of Rs.25,000/- (Rupees Twenty Five
Thousand) each, including one local surety, to the satisfaction of
the learned trial Court for their appearance before that Court on
each and every date of hearing and whenever called upon to do so
till the completion of the trial.
