Fact of the Case:
The petitioners, who were working as Court Managers in the High Court administration as well as District Courts, filed a petition seeking regularization of their services in line with the directions issued by the Supreme Court in the case of All India Judges Association and others versus Union of India and others.
Finding of the Court:
The High Court held that the directions of the learned Single Judge are being implemented and for which purpose the recruitment rules have been framed and eligibility and suitability would be examined before granting the regularization.
Issues: 1. Whether the State Government can regularize the services of Court Managers in absence of sanctioned posts?2. Whether the High Court administration has undertaken the exercise for regularizing services of the existing Court Managers?
Ratio Decidendi: 1. The main opposition of the State Government to the order passed by the learned Single Judge that there cannot be any regularization in absence of sanctioned posts, thus would no longer survive.2. The directions issued by the learned Single Judge for regularization of the services of the Court Managers are in consonance with the observations and directions of the Supreme Court in order dated 02.08.2018 passed in the case of All India Judges Association (supra).
Final Decision: The appeal is disposed of.
