Order
03/03/2022
In wake of instant surge in COVID-19 cases and spread of its
highly infectious Omicron variant, abundant caution is being
maintained, while hearing the matters in Court, for the safety of
all concerned.
Mr. Direndra Singh, learned Senior Counsel assisted by Ms.
Priyanka Borana makes two core arguments; firstly, Madan Patidar
has released on bail by this Court in S.B. Criminal Misc. Third Bail
Application No.16196/2021 decided on 15.02.2022; Second is that
the core allegation of being caught at the time of confiscation of
the contraband in question was upon Madan Patidar.
Learned P.P. opposes the bail application.
Looking into the fact that petitioner has 16 previous criminal
antecedents, out of which, in 11 cases the petitioner has

acquitted, but the allegation upon the petitioner is that of firing
upon the police team and so much so that even one constable
Rajesh was severely injured, this Court is not inclined to grant bail
to the present petitioner.
In view of the above, the present fifth bail application is
dismissed.
