The petitioner has filed this writ petition being aggrieved by

the action of the respondents of not providing information to him

under the Right to Information Act, 2005 (for short ‘the Act of

2005’).

It is submitted by learned counsel for the petitioner that the

petitioner has filed application before the Gram Panchayat, Nimaj

under the Act of 2005 seeking some information, however, the

said Gram Panchayat has not supplied him the desired

information.

The first appeal filed by the petitioner was allowed by the

Panchayat Samiti, Jaitaran, Pali and a direction was issued to the

Gram Panchayat concerned to supply the desired information,

despite that, the said information was not provided to him. The

petitioner has filed second appeal before the Rajasthan State

Information Commission (for short ‘RSIC’) and the RSIC vide

order dated 8.9.2021 has also directed the Gram Panchayat

concerned to supply the desired information to the petitioner.

Learned counsel for the petitioner has submitted that despite

the order passed by the RSIC, the Gram Panchayat concerned did

not supply the desired information to the petitioner. The petitioner

has moved an application before the RSIC with a prayer to get the

order passed by it executed which is still pending and the RSIC is

not acting upon it.

Having heard learned counsel for the petitioner and after

going through the material available on record, I do not find any

case for interference in this writ petition while exercising powers

under Article 226 and 227 of the Constitution of India, however,

the petitioner is free to approach the RSIC for expeditious disposal

of his application.

If any such request is made on behalf of the petitioner, it is

expected that the RSIC shall consider and decide the same strictly

in accordance with law.

With these observations, this writ petition is dismissed.

Stay petition is also dismissed.
