Order

06/01/2022

The criminal misc. petition No.3640/2021 is filed by

petitioner–Khema Ram with a prayer to direct the police

authorities to conduct fair and impartial investigation into the FIR

No.75/2021 of Police Station Makrana, District Nagaur.

The criminal misc. petition No.1511/2021 is filed by the

petitioners - Bhagirath Singh Rajpurohit, Ridh Singh and Hanuman

Singh with a prayer to quash the FIR No.75/2021 of Police Station

Makrana, District Nagaur.

Learned Public Prosecutor has submitted a factual report,

wherein it is mentioned that the police after thorough

investigation in the impugned FIR is going to file charge-sheet

against the petitioners - Bhagirath Singh Rajpurohit, Ridh Singh

and Hanuman Singh before the court concerned for the offences

punishable under Section 341 IPC and Section 3(1)(r)(S)(Za)(b),

3(2)(va) of SC/ST Act.

In view of the fact that investigation into the impugned FIR

has already been completed and the police is going to file charge-

sheet against the petitioners - Bhagirath Singh Rajpurohit, Ridh

Singh and Hanuman Singh before the court concerned, I am not

(3 of 3)

inclined to interfere in these criminal misc. petitions and the same

are hereby dismissed.

However, the petitioners - Bhagirath Singh Rajpurohit, Ridh

Singh and Hanuman Singh are free to surrender before the

concerned court within a period of four weeks from today.

After their surrender, if the petitioners - Bhagirath Singh

Rajpurohit, Ridh Singh and Hanuman Singh move regular bail

application before the court concerned, it is expected that the

same shall be considered and decided expeditiously while taking

into consideration the fact that all the above three petitioners are

senior citizens.

The factual report submitted by the learned Public Prosecutor

is taken on record.
