Heard learned counsel for the parties. Perused the material

available on record.

A rent eviction application was filed by the owner of the suit

premises i.e. Jodharam against the tenant Shri Surajmal Naveen.

The Tribunal decreed the same by judgment dated 11.03.2015.

The petitioners, claiming to be owners of the property on the

strength of agreement to sale, challenged the said judgment by

filing an appeal under the provisions of the Rajasthan Tenancy Act

which was rejected by the learned Appellate Tribunal as beingnot

maintainable at the instance of the persons who were neither the

tenant nor the landlord. The Appellate Tribunal observed that if so

desired, the petitioners could have filed a suit in the competent

civil court seeking declaration of their ownership rights on the

property in question.
