The present petition has been filed to challenge the

Notification dated 6.10.2008 issued by the Governor of

Rajasthan in exercise of powers conferred by the proviso to

Article 309 of the Constitution of India which amends the

Rajasthan Animal Husbandry Subordinate Service Rules,

1977 ('for short 'the Rules of 1977') with retrospective

effect.

The petitioner was appointed as Class IV Employee

with the Department of Animal Husbandry vide order dated

21.3.1970. In the year 1990-91, he underwent regular
