This intra court D.B.Civil Special Appeal arises out

of the judgment of the learned Single Judge dated 10th

August, 2001, by which he allowed the writ petition and

while setting aside the order of the Collector dated

25.8.1987, a declaration was made that the transfer

made in favour of Shri Ghanchi Mahasabha of the land

forming part of the Sardar Samand Estate held by the

erstwhile ruler of Marwar, declared by this court to be
