Heard learned counsel for the petitioner and learned Public

Prosecutor. Perused the material available on record.

The instant bail application under Section 439 Cr.P.C. has

been preferred on behalf of the petitioner who is in custody in

connection with F.I.R. No.128/2017, registered at Police Station

Kotwali Nimbahera, District Chittorgarh for the offences under

Sections 354A, 354D, 457 IPC and Section 12 of the POCSO Act.

The victim Mst. ‘M’ in her statement recorded under Section

164 Cr.P.C., did not name the present petitioner as her stalker.
