These applications for bail have been filed by the petitioners

Kausar Ali and Avsar @ Afsar under Section 439 of the Cr.P.C. in

connection with FIR No. 330/2018, Police Station Lalgarh Jatan,

District Sri Ganganagar, for the offences under Sections 3/8, 9 and

10 of the Bovine Animals Act.

Heard learned counsel for the petitioners and learned Public

Prosecutor and also perused the material available on record.

Mr. Kulwant Singh, learned counsel for the petitioners

submits that other co-accused Sultan and Mangala Ram have

already been enlarged on bail by this Court, vide separate orders

dated 18.2.2019 and 22.1.2019 and that the case against both

the applicants, Kausar Ali and Avsar @ Afsar is not different than

the case which is against Sultan and Mangala Ram.

Learned Public Prosecutor is not in a position to controvert

the aforesaid factual position.

Having regard to the facts and circumstances of the case and

without expressing any opinion on the merits/demerits of the

case, this Court is of the opinion that the bail applications filed by

the petitioners deserves to be accepted.

Consequently, the bail applications filed under Section 439

Cr.P.C. are allowed. It is ordered that petitioners (i) Kausar Ali S/o

Kamil and (ii) Avsar @ Afsar S/o Noorhasan arrested in FIR No

330/2018, Police Station Lalgarh Jatan, District Sri Ganganagar

shall be released on bail; provided they execute personal bonds in

the sum of Rs. 50,000/- each and two sureties of Rs.25,000/- to

the satisfaction of the learned trial Court with the stipulation to

appear before that Court on all dates of hearing and as and when

called upon to do so.
