ORDER

This writ petition has been filed by the petitioner

seeking a direction for the respondent-RIICO to

complete the formalities and hand over the plot No. SP-

3 to the petitioner as per its decision dated 16.07.2010

(Annex-5).

Learned counsel for the petitioner submits that the

respondent-RICCO is not implementing its decision

dated 16.07.2010 on the ground that one M/s R.K.

Textile has filed a writ petition No. 5971/2010 before

this Court with a prayer for allotment of the very same

plot SP-3 and as the said writ petition is still pending,

therefore, the decision dated 16.07.2010 cannot be

implemented. Learned counsel for the petitioner has

also informed that the petitioner has moved an

application for being impleded as party respondent in

S.B. Civil Writ Petition No. 5971/2010 and the same is

pending consideration.

In view of the fact that the application of the

petitioner for being impleded as party respondent in

writ petition No. 5971/2010 is still pending, I am not

inclined to interfere in this writ petition at this stage.

Hence, this writ petition is dismissed.

Stay petition also stands dismissed.
