HIGH COURT OF JUDICATURE FOR RAJASTHAN
ARUN BHANSALI
LALITA – Appellant
Versus
STATE OF RAJASTHAN – Respondent
CW/9145/2022

An opportunity of hearing is a fundamental principle of natural justice that must be provided before any adverse decision is made against a person.

Headnote:

EXCISE - DEMAND NOTICE - OPPORTUNITY OF HEARING - Petitioners aggrieved by demand notice issued without opportunity of hearing - Petitioners directed to file response within 10 days - Competent authority to decide response within 3 weeks - Demand notice not to be enforced till decision made.

Fact of the Case:

Petitioners, holders of liquor licenses, challenged a demand notice issued by the Excise Department without providing them an opportunity to be heard. They claimed to have already made the required payments and that the demand was contrary to the Excise Policy.

Finding of the Court:

The court found that the demand notice was issued based on an audit objection without providing the petitioners an opportunity to be heard. The court held that the demand could not be sustained without such an opportunity.

Issues: Whether the demand notice was issued without providing the petitioners an opportunity to be heard.

Ratio Decidendi: The court relied on the principle of natural justice, which requires that before any adverse decision is made against a person, they must be given an opportunity to be heard.

Final Decision: The court directed the petitioners to file their response to the demand notice within 10 days. The competent authority was directed to decide the response within 3 weeks. The court also ordered that the demand notice not be enforced until the decision was made.
