This bail application under Section 439 Cr.P.C., is laid by

petitioner in connection with an FIR, wherein he is charged for

offence punishable under Sections 302 and 201 IPC.

It is submitted by learned counsel for the petitioner that the

entire prosecution case is edificed on circumstantial evidence.

Learned counsel would contend that the three witnesses, viz.,

P.W.1 Babu, P.W.4 Shankar and P.W.5 Raju Purabiya allegedly

connecting petitioner with the alleged offences have turned hostile
