Order

02/09/2021

This intra court appeal is directed against the order dated

11.08.2021 passed by learned Single Judge of this Court, whereby

writ petition preferred by the writ-petitioner/appellant herein,

seeking directions to the respondents to permit her to appear in

the B.P. Ed. 3rd Semester Examination-2021, has been declined.

The learned Single Judge has declined the prayer for interim

relief noticing the fact that the petitioner’s admission itself has

been cancelled vide order dated 24.02.2021.

It is not disputed before us that cancellation of the admission

is not even challenged in the writ petition. The writ-petitioner was

(2 of 2)

[SAW-493/2021]

not permitted to appear in examination, inasmuch as she didn’t

attend on-line and off-line classes, therefore, her attendance was

short.

In view of the subsequent event, no interim relief could have

been granted in favour of writ-petitioner/appellant and, therefore,

we are in agreement with the view taken by the learned Single

Judge.

No interference by us in intra court appeal jurisdiction is

made out.

The special appeal is, accordingly, dismissed.
