This criminal misc. petition under Section

482 Cr.P.C. has been filed by the petitioner

with a prayer for quashing the order dated

05.11.2012 passed by the Chief Judicial

Magistrate, Jodhpur (hereinafter referred to as

'the trial court') in Criminal Regular Case

No.323/2011, whereby an application filed by the
