S.B. CIVIL WRIT PETITION NO.1445/2011
Akhil Rajasthan Lab Technician Karamchari Sangh
Vs.
Director, Medical & Health Department, Jaipur & Ors.
DATE OF ORDER :
17.2.2011
HON'BLE MR. GOVIND MATHUR, J.
Mr. H.S. Shrimali, for the petitioner.
...
Permission is sought by learned counsel for the petitioner
to implead the Superintendent, PBM Hospital, Bikaner as party-
respondent No.4. The request is allowed. The Superintendent,
PBM Hospital, Bikaner is impleaded as party respondent No.4.
Necessary inclusion is made by learned counsel for the petitioner
in his own handwriting before the Court.
By short-term advertisement dated 27.2.2011 (Annex.7),
the Principal, Sardar Patel Medical College, Bikaner invited
applications from eligible desirous candidates to be considered
for appointment to the post of Technician against 51 existing
vacancies. The grievance of the petitioner is that as a matter of
fact no post of Technician at present exists in view of the fact
that the post aforesaid stood amalgamated with the post of Lab
Technician much back in the year 1982.
From perusal of the record, it reveals that a representation
was given by the petitioner-Union to the respondents and that
2
was considered by the competent authority. The competent
authority referred the matter to the State Government with the
opinion that the designation as given is required to be
substituted by a Lab Technician.
The State Government in its turn under a letter dated
27.12.2010 instructed the Superintendent, PBM Hospital, Bikaner
to take appropriate action at local level. It is submitted by
learned counsel for the petitioner that no action is yet taken and
the respondents are proceeding with the process of selection
under the advertisement dated 27.1.2011.
This petition for writ stands disposed of with a direction to
respondent No.4 - Superintendent, PBM Hospital, Bikaner to take
appropriate decision in pursuant to the document (Annex.5)
dated 27.12.2010 issued by Deputy Secretary to the
Government of Rajasthan, Department of Medical & Family
Welfare Service, Jaipur expeditiously, as far as possible within a
period of two weeks from today but prior to completion of the
process of selection.
