Order

28/09/2022

This writ petition has been filed by the petitioner aggrieved

against the order dated 28.07.2022 (Annex.12) passed by the

respondents, whereby the petitioner has been placed Awaiting

Posting Order (APO) and her headquarter has been fixed at Ajmer.

(2 of 2)

[CW-11138/2022]

A response to the petition has been filed, inter-alia,

indicating that as an enquiry under Rule 17 of the Rajasthan Civil

Services (Classification, Control and Appeal) Rules, 1958 (‘Rules of

1958’) was pending against the petitioner, the petitioner could not

perform the function as Sub-Registrar, inasmuch as she was not

empanelled on account of the restriction imposed with regard to

pendency of disciplinary proceedings.

The petitioner had inter-alia challenged the order on account

of the fact that the proceedings pending against her under Rule 17

of the Rules of 1958 were stayed by this Court.

By interim order dated 08.08.2022 the effect and operation

of the order impugned dated 28.07.2022 qua the petitioner was

ordered to remain stayed.

Whereafter, CWP No.17208/2021, wherein the proceedings

against the petitioner under Rule 17 were stayed by this Court

came to be dismissed by order dated 14.09.2022.

In view of the fact that the writ petition filed by the

petitioner against the proceedings under Rule 17 of Rules of 1958

stands dismissed, wherein an interim order was in currency, in

view of reply filed by the respondents, the challenge laid by the

petitioner to the order dated 28.07.2022 (Annex.12) placing her

APO from the post of Sub Registrar, has no substance.

The petition is, therefore, dismissed.

It would be required of the respondents to pass order

according appropriate posting to the petitioner by 30.09.2022.
