ORDER
The petitioner is being aggreived with the order
dated 2.7.2016 passed by the Principal, Nishkramaniya
Pashupalak, Government Upper Secondary Residential
School Village Hariyali, District Jalore. (respondent
No.2,) whereby, the tender bid submitted by the
respondent No.3 in response to the tender notice
dated 2.6.2016 has been accepted.
It is contended by the learned counsel for the
petitioner that the respondent No.3 is not fulfilling
qualification as mentioned in the tender notice dated
2.6.2016 but despite that the respondent No.2 has
accepted bid of the respondent No. 3 in illegal manner.
It is contended that the petitioner has already moved a
representation before the respondent No.2, rasing
objection regarding acceptance of the tender bid of the
respondent No.3, however, the respondent No. 2
without deciding the said objection of the petitioner is
bent upon to issue work order in favour respondent
No.3.
Learned counsel for the petitioner has therefore,
prayed that a direction be issued to respondent No.2 to
decide his representation dated 19.7.2016 (Annex. 3)
expeditiously.
In view of limited prayed made by the learned
counsel for the petitioner, this writ petition is disposed
of with the direction to the respondent No.2 to decide
the representation of the petitioner dated 19.7.2016
(Annex.3) expeditiously, preferably within a period of
one week from the date of production of certified copy
of this order, strictly in accordance with law.
