Heard learned counsel for the petitioner as well as

learned Public Prosecutor and also perused the material on

record.

The petitioner has been arrested in FIR No.282/2017

of Police Station, Kotgate district Bikaner for the offence

punishable under Section 379 IPC. He has preferred this

bail application under Section 439 Cr.P.C.

Learned counsel for the applicant submits that no

previous conviction has been recorded against the

petitioner and the offence is triable by Ist Class Magistrate.

Learned Public Prosecutor has opposed the ba
