The matter comes up on an application under Section 5 of
the Limitation Act for condonation of delay.
2.
For the reasons stated in the application, the same is
allowed.
3.
The delay in filing the revision petition is condoned.
4.
Heard on revision petition.

Learned counsel for the petitioner seeks withdrawal of the
instant criminal revision petition with liberty to challenge the order
dated 29.04.2023 passed by Juvenile Justice Board, Jaisalmer by
way of filing an appeal under Section 101 of the Juvenile Justice
Act before the concerned Session Judge.

Accordingly, the instant criminal revision petition is dismissed
as withdrawn with liberty as sought for. However, if the appeal is
filed within next 30 days along with an application under Section 5

of the Limitation Act, the learned Session Judge shall consider the
condonation of delay sympathetically, for the reason that owing to
inadvertence a wrong forum had been approached earlier, which
consumed much time.

Stay petition is also dismissed.
