This bail application under Section 439 Cr.P.C. has been filed
by petitioner in connection with FIR No.109/2021, registered at
Police Station Kolayat, District Bikaner wherein he is charged for
offences punishable under Sections 306 IPC.
Learned counsel for the petitioner contended that on the
basis of suicide note of deceased and call recorded having
conversation of deceased with the present petitioner, the
petitioner has been implicated in this case as an accused for the
offence of abatement to commit suicide. It is further contended
that the deceased was suffering from some ailment for which he
has taken medicines from the present petitioner and since the
medicines were not curing the disease, moreover, the deceased
had obtained loan from certain persons. It is also stated that on
the basis of evidence collected and produced by the police, no
offence of abatement to commit suicide is made out against the

petitioner and bail application of co-accused Vijendra Singh S/o
Ummed Singh bearing S.B. Criminal Misc. 2nd Bail Application
No.13946/2021 and Smt. Rekha D/o Gulab Singh, W/o Raj Kumar
bearing S.B. Criminal Misc. Bail Application No.12811/2021 have
already been accepted by the Coordinate Benches of this Court
vide orders dated 18.10.2021 and 23.09.2021, respectively.
Lastly, learned counsel has stated that petitioner is in custody
since 21.06.2021 and after completion of investigation, charge-
sheet has been filed in the matter.
Learned Public Prosecutor has opposed the bail application.
Having heard learned counsel for the parties and considering
the contentions put forth by learned counsel for the petitioner and
looking to the contents of suicide note and call recordings,
without expressing any opinion on merits or demerits of the case,
I deem it just and appropriate to grant indulgence to the
petitioner by enlarging him on bail.
Accordingly, the bail application under Section 439 Cr.P.C. is
allowed and it is ordered that accused-petitioner Prahlad Singh
S/o Asmaal Singh,
arrested in connection with F.I.R.
No.109/2021, Police Station Kolayat, District Bikaner may be
released on bail; provided he furnishes a personal bond of
Rs.50,000/- with two surety bonds of Rs.25,000/- each to the
satisfaction of learned trial Court with the stipulation to appear
before that Court on all dates of hearing and as and when called
upon to do so.
