Learned counsel for the petitioner submits that despite the
long drawn proceedings for declaring the land into a command

land and also the observations by various authorities that it is a
land, which is fit to be declared as a command land, the final
decision regarding the same has not been taken.
Learned counsel for the petitioner has drawn attention of this
Court towards the Annexure-15, in which learned authority himself
has recommended that the land in question be declared as a
command land.
Learned counsel for the respondent assures this Court that
they shall take the decision regarding the status of command land
of the present petitioner in a time-bound manner, strictly in
accordance with law.
In light of the aforesaid submission, the present petition is
disposed of while directing the respondents to decide the claim of
the petitioner to get the irrigation by declaring the land in
question as command land while keeping into consideration
Annexure-15 of the writ petition and other documents, which
indicate that there was a positive consideration for declaration of
command land and such decision shall be taken strictly in
accordance with law within a period of three months from today.
Stay petition as well as all pending applications also stand
disposed of accordingly.
