Heard learned counsel for the parties and perused the

materials available on record.

This bail application under Section 439 Cr.P.C., is laid by

petitioner in connection with an FIR, wherein he is charged for

offence punishable under Sections 147, 148, 149, 323, 307 and

436 IPC.

While it is true that investigation against petitioner is still

pending under Section 173(8) Cr.P.C., but undeniably other co-

accused persons, who were also involved in commission of alleged

offence, have been enlarged on bail by this Cou
