Issue notice.

Notice is accepted by Mr. Anand Sharma, learned Central

Government Standing Counsel.

This writ petition has been filed seeking a direction to the

respondent to expeditiously decide petitioner’s application

No.1248546 for registration of trade mark “AYU-HINA” in

accordance with law.

Learned counsel for the petitioner, inviting attention of this

Court towards the provisions of Section 23(1)(b) of the Trade

Marks Act, 1999, submitted that its application for registration of

trade mark filed in the year 2003 was required to be decided

within the period of 18 months; but, it is pending till date. He,

therefore, prays for a direction for its expeditious disposal.

Learned counsel for the respondent did not dispute the

aforesaid proposition.

In view thereof, this writ petition is disposed of with a

direction to the respondent to decide the application No.1248546

for registration of trade mark “AYU-HINA” within a period of three

months from the date of communication of this order.
