By way of this writ petition, the petitioner-RSRTC

(hereinafter to be referred as the Corporation) has challenged the

award dated 08.09.1995 passed by the Labour Court, Bharatpur

whereby the termination of respondent No.1 (hereinafter to be

referred as workman) was held to be legal, however, the workman

was held entitled for back wages.

Counsel for the corporation submitted that the award passed

by the learned Labour Court is illegal as once the learned Labour

Court came to a conclusion that the termination of the workman

from service is just and legal, the learned Labour Court seriously

erred in awarding the back wages to the workman.

None appeared on behalf of the workman despite service.
