Heard learned counsel for the parties.

This Court asked learned counsel for the petitioner

Mr.Amit Jindal as what has been been challenged by the petitioner

in the present writ petition.

Learned counsel for the petitioner very fairly submitted

that the present writ petition was filed by the petitioner

challenging the order dated 16.12.2013, whereby, application

under Section 73 of the Evidence Act was allowed by the

[CW-1323/2014]

Additional District Judge No.9, Jaipur Metropolitan, Jaipur and as

such, the documents were sent to the FSL for its report.

Learned counsel for the petitioner submitted that

during pendency of the misc. restoration application, the suit filed

by the petitioner-plainitff has been decided and as such, the writ

petition has become infructuous.

This Court, in view of subsequent developments taken

place, dismisses the writ petition as having become infructuous.
