HON'BLE MR. JUSTICE SUDESH BANSAL

Order

08/04/2022

This pauper application was filed by appellants through

power of attorney holder invoking provisions of Order 33 Rule 1

CPC seeking exemption to pay the court fees of Rs.30,067/- in

order to file the appeal as indigent persons.

The pauper application was filed way back on 14.02.2008

alleging inter alia that appellant No.1 is an old lady of 80 years

and appellant No.2 is a minor person of 10 years who do not

possess any property except the property in dispute. Though the

Court issued notices and directed for enquiry about the properties

of appellants, however, now about 14 years have passed.

Appellants have not produced any judgment against which

they want to file the first appeal.

From perusal of pauper application, it appears that a bare

averment has been made that appellants want to file appeal.

Since the pauper application is pending for about 14 years

without any persuasion, it seems that the same has rendered

infructuous with the passage of time.

Accordingly, the pauper application is dismissed.
