Instant intra court appeal has been filed against order of the

learned Single Judge dt.29.01.2014.

At the outset we may record that as regards the liability &

default as provided under the Employees Provident Fund &

Miscellaneous Provisions Act,1952, it is not disputed/denied by the

appellant and contribution for the effective period from

January,1981 to September,1995 was deposited in two installments

respectively on 08

th & 13

th March,1996.

However, the Commissioner was justified in passing order

claiming damages u/S 14B of the Act,1952. The matter was

travelled to the Provident Fund Commissioner and thereafter in

appeal and before the learned Single Judge and it was observed

that there was no bonafide delay in depositing the contribution of

last 15 years and once the appell
