Heard counsel for the accuse-petitioners and learned Public

Prosecutor through video conferencing.

Learned counsel for the accused-petitioners submitted that

the Police has completed investigation and has filed charge sheet

against the accuse-petitioners.

Learned counsel further submitted that trial of the case will

take time and the accuse-petitioners are in custody from more

than 90 days.

Learned counsel further submitted that the complainant

himself was law violator and he had encroached the forest land.

Learned Public Prosecutor has opposed the bail applications

and submitted that the accuse-petitioners are guilty of the

offences punishable under Sections 7, 7A of Prevention of

Corruption (Amendment) Act, 2018 and under Sections 384 and

120-B of IPC.

Considering the contention raised by learned counsel for the

accused-petitioners and custody of the accuse-petitioners as well

as taking into account the facts and circumstances of the case and

without expressing any opinion on the merits of the case, this

court deems it just and proper to enlarge the accused-petitioners

on bail.

Accordingly, the present bail applications under Section 439

Cr.P.C. are allowed and it is ordered that the accused-petitioners

(i) Mahaveer Prasad Verma S/o Shri Gobarilal Verma (ii) Biram Lal

Gurjar S/o Shri Baldev and (iii) Vijay Singh Gurjar S/o Shri Ram

Niwas Gurjar shall be enlarged on bail provided each of them

furnishes a personal bond in the sum of Rs.20,000/- with one

surety of alike amount to the satisfaction of learned trial Judge for

their appearance before the court concerned on all the dates of

hearing and as and when called upon to do so.

A copy of this order be separately placed in each connected

file.
