The instant intra court appeal is directed against the order of

the ld. Single Judge dt. 4^th January, 2017.

The Revenue suit was filed at the instance of the

plaintiff/respondents in the court of Sub-Division Officer, Dausa for

partition & permanent injunction of the subject land in question

measuring 10.14 hectares in Khasra No. 21 situated in Village

Ganeshpura, Tehsil & District Dausa. After the service of notice on

the defendant-appellants, written statement was filed and in paras

1 & 2 of the written statement, it was their own admission that

they are two brothers and both are entitled for equal share out of

the property which has been devolved f
