The petitioners have instituted the misc. application with a

prayer for recall of the order dated 27^th July, 2016, made by this

Court granting permission to withdraw the writ application for the

counsel for the petitioner(s) under instructions, made the

statement.

Mr. Rajvir Sharma, learned counsel appearing on behalf of

the petitioner/applicant No. 2 (Keshar Lal) submits that legal

representatives of the petitioner No. 1 (Kishtoor Chand-deceased),

in connivance with the private respondents played a fraud and

withdrew the writ application without any consent and/or

instructions to that effect by petitioner/applicant (Keshar Lal).

Referring to the opinion of Apex Court of the land in the case

of Himalayan Coop. Group Housing Society Vs. Balwan Sing
