Present petition has been filed under

Section 482 Cr.P.C. seeking quashing of FIR

No.2/2006 registered at Excise Police Station

Kailadevi District Karauli for offence under

Section 58-C of Rajasthan Excise Act, 1950.

As per the averment made in the

petition, petitioner No.1 Mukesh Pal at a

relevant time was licenced to conduct the

business of liquor on license shop at Gram

Panchayat Kudgaon. The licence had been issued

to him by the excise department which was valid

from 1st April, 2006 to 31st March, 2007.

License issued to the petitioner No.1 has been

annexed with the present petition as Annexure-1

and Annexure-2 respectively. On 15th August,

2006, ASI Govind Singh had conducted the raid

and found that on 15th August, 2006 i.e.

independence day, liquor shop was kept open by
